In order to implement the law on the prevention and control of occupational diseases amended and implemented at the 21st Meeting of the Standing Committee of the 12th National People's Congress on July 2, 2016 and further improve the supervision and administration of the control of radioactive occupational hazards in medical institutions, the relevant requirements are hereby notified as follows:
1、 Unify ideological understanding and accurately understand the relevant provisions of the law on the prevention and control of occupational diseases
The control of radiation occupational hazards in medical institutions is not only related to the occupational health protection of medical personnel, but also related to the health and safety of patients and the public. The newly revised law on the prevention and control of occupational diseases further defines the supervision and management of the administrative department of health and family planning on the control of radioactive occupational hazards in medical institutions. Local health and family planning administrative departments shall organize and urge medical institutions, radiation health technical service institutions, health and family planning supervision and law enforcement agencies and disease prevention and control agencies to strengthen the study of the newly revised law on the prevention and control of occupational diseases, accurately understand the relevant provisions of the law, further improve understanding, unify thinking, and earnestly implement the relevant responsibilities and tasks of the law on the prevention and control of occupational diseases.
2、 Implement the main responsibility and strengthen the preliminary prevention of radiation occupational hazards in medical institutions
The newly revised law on the prevention and control of occupational diseases further defines the pre evaluation of construction projects with radioactive occupational hazards in medical institutions, the design review of protective facilities for construction projects with serious hazards, the evaluation of control effect and the completion acceptance of occupational hazards. Medical institutions should earnestly enhance legal awareness, do a good job in the early prevention of radioactive occupational disease hazards, and implement the main responsibility. For construction projects that may cause radioactive occupational disease hazards, medical institutions shall submit a pre evaluation report on radioactive occupational disease hazards to the administrative department of health and family planning. The design of protective facilities for construction projects with serious hazards shall be included in the pre evaluation report. If the pre evaluation report is not submitted or the pre evaluation report is not examined and approved by the health and family planning administrative department, the construction shall not be started. Before applying to the health and family planning administrative department for completion acceptance, the control effect of radioactive occupational disease hazards shall be evaluated. The pre evaluation and control effect evaluation shall be carried out by radiation health technical service institutions with relevant qualifications.
Health and family planning administrative departments at all levels shall, in accordance with the requirements of the law on the prevention and control of occupational diseases and the provisions on the health examination of radiation diagnosis and treatment construction projects, earnestly review the pre evaluation report and completion acceptance of radiation occupational disease hazard construction projects in medical institutions. During the completion acceptance of the construction project of radioactive occupational disease hazards in medical institutions, the on-site audit required for the application of radiation diagnosis and treatment license of medical institutions shall be included. If the completion acceptance of the construction project of radioactive occupational disease hazards is passed, the on-site audit shall not be carried out when applying for radiation diagnosis and treatment license.
3、 Standardize the service management and strengthen the technical service of radiation health
Radiation health technical service institutions should firmly establish the awareness of law, responsibility and service, constantly improve the quality management system, strengthen quality control and management, and improve the service quality; In strict accordance with relevant national laws, regulations and technical standards, provide medical institutions with evaluation of radioactive occupational disease hazard construction projects and detection of radioactive occupational disease hazard factors; We should comprehensively strengthen the professional training and professional ethics education of employees, earnestly implement the main responsibility, strictly standardize the technical service behavior, do not carry out technical service beyond the approved scope, and the evaluation and test reports should be objective and true, and no fraud is allowed.
The provincial health and family planning administrative departments shall, in accordance with Articles 9, 26 and 87 of the law on the prevention and control of occupational diseases and the notice on the division of responsibilities of occupational health supervision departments (Central Compilation office Fa [2010] No. 104) According to the requirements of the measures for the administration of radiological health technical service institutions and the notice of the national health and Family Planning Commission on strengthening supervision after the decentralization of approval responsibilities of radiological health technical service institutions (Class A) (gwjf [2015] No. 75), the radiological health technical service institutions shall be strictly approved and supervised.
4、 Strengthen supervision and law enforcement, and seriously investigate and deal with violations of laws and regulations
Health and family planning administrative departments at all levels and their supervision and law enforcement agencies should strengthen the construction of radiation health supervision and law enforcement team, strengthen personnel training, effectively improve the level of supervision and law enforcement, and supervise and guide medical institutions and radiation health technical service institutions to fully implement their main responsibilities. In the daily supervision and law enforcement work, we should focus on strengthening the supervision and inspection of the pre evaluation, control effect evaluation, completion acceptance and other conditions of the construction projects of radioactive occupational hazards in medical institutions. If it is found that the construction project of radioactive occupational disease hazards in medical institutions has not been started without pre evaluation and review, it shall be ordered to stop immediately; Those who fail to carry out control effect evaluation, completion acceptance and diagnosis and treatment activities shall be required to stop the diagnosis and treatment activities immediately and be dealt with seriously according to law and regulations. At the same time, it is necessary to strengthen the supervision and inspection of radiation health technical service institutions, focusing on the qualification, service scope and issuance of supporting documents of radiation health technical service institutions. The violations found shall be resolutely investigated and dealt with in place in accordance with the law on the prevention and control of occupational diseases and other laws and regulations, so as to effectively protect the health and safety of medical personnel, patients and the public.
